Legal
Terms
- Reading this site and sending the contact form is fine. Using it means you accept these terms.
- What's here is general information. It isn't legal, tax or financial advice, and it isn't a promise of results.
- The 7-Day Missed-Call Rescue and the paid monthly service run on their own terms: the founding pilot terms and a written price. Those come first.
- Tennessee law applies. If something goes wrong, call me first.
Who these terms are with
This site is operated by Helmgrove LLC (“Helmgrove,” “I” and “me”). Helmgrove is run by Jesse Martinez, based in Clarksville, Tennessee.
By using this site, you agree to these terms and to the Privacy Policy. If you don't agree, please don't use the site. The site is written for business owners and people acting for a business. You should be 18 or older.
What this site is
This site gives information about Helmgrove, a lead-response service: missed-call text-back, after-hours replies and lead alerts, set up for owner-run businesses. Nothing on the site is a binding offer. A service starts only when you and I agree in writing, under the founding pilot terms or a written price.
Using the site
You can read the site, link to it, send the contact form, and call or text the numbers on it. Please don't:
- use the site for anything unlawful;
- send information that is false or misleading, or someone else's details without their permission;
- send Social Security numbers, bank or card numbers, or passwords through the contact form;
- scrape the site with automated tools, overload it, or try to break or get around its security;
- send malicious code, spam or anything meant to harm the site or the people using it;
- pretend to be someone else.
I may block access if someone does these things.
What's on the site
- I try to keep the site accurate and up to date, but it may have mistakes or be out of date. The date at the top of each legal page shows when it was last updated.
- Examples on this site use fictional businesses and fictional numbers. They are not real customers or results.
- The calculator gives your estimate from your own numbers. It is not a prediction or a promise of results. Nothing you type into it is saved or sent.
- Helmgrove sends texts and alerts. It doesn't answer calls, and it doesn't promise more sales or jobs. Texts reach mobile numbers only, and delivery depends on the carriers.
Services are agreed separately
The 7-Day Missed-Call Rescue, including the founding pilot, is covered by the founding pilot terms and by anything else you and I agree in writing. The paid monthly service is covered by a written price and the terms we agree before it starts. If those differ from this page, they win for that service.
Texts, calls and email
If you give me your mobile number, the SMS Terms and the Privacy Policy apply. Ticking the text box on the contact form is optional, and you can send the form without it.
What you send me
If you send me feedback or ideas about the site or the service, I may use them to improve the service, without owing you anything and without naming you. Your business information is handled under the Privacy Policy and, if you join the pilot, the pilot terms. I don't use your name, your business name or your numbers publicly without your written OK.
Ownership of the site
The text, design and code of this site, and the Helmgrove name and logo, belong to Helmgrove LLC or are used with permission. You may link to the site and quote short parts of it with credit. Please don't copy the site or present it as yours.
Product and company names mentioned on this site are trademarks of their owners. Helmgrove isn't affiliated with or endorsed by them.
Links and outside services
The site links to, and relies on, services run by other people, such as the form provider, scheduling and Google Fonts. I don't control them, and their own terms and privacy policies apply when you use them.
No professional advice
I'm not a lawyer, an accountant or a financial adviser. Nothing on this site is legal, tax or financial advice. Rules about texting and calling customers apply to your business too. If you want advice about your own obligations, talk to a lawyer.
No warranties on the site
The site is provided “as is.” I work to keep it running and correct, but I can't promise it will always be available, error-free or right for what you need. This doesn't change any guarantee I make in writing about my services, such as the ones on the pilot terms page.
Limits on my liability
To the extent the law allows, I'm not liable for indirect, incidental, special or consequential losses, such as lost profits, lost jobs or lost data, that come from using this site or not being able to use it. Nothing in these terms limits responsibility for fraud or intentional harm, or any right you have that the law doesn't let anyone waive.
Changes
I may change the site and these terms. The date at the top shows when they last changed, and using the site after a change means you accept it. For a significant change, I'll also put a notice at the top of this page for at least 30 days.
Tennessee law and disagreements
Tennessee law governs these terms. If you and I disagree about something, please call or text me first. Most problems are quick to fix. If we can't sort it out, either of us may go to the state courts of Montgomery County, Tennessee, or to the federal court that covers Montgomery County, and we both agree those courts can hear it. Nothing here takes away rights that your own state's law gives you and that can't be waived.
Everything else
These terms, the Privacy Policy and the SMS Terms are the whole agreement about your use of this site. If a part of them can't be enforced, the rest still applies. If I don't enforce something right away, I haven't given up the right to.
Contact
Call (559) 840-7710, text the same number, or email jesse@helmgrove.com. I reply within one business day. If anything on this site is hard to use, tell me and I'll fix it.
